Reasons for Health Care Plan

You will need to explain to the court why the Child Health Care plan you want is in the best interest of your children. If both Petitioner and Respondent agree, the reason can be something like: Petitioner and Respondent agree that this health plan is in the best interest of our children.

If Petitioner and Respondent do not agree, then you should carefully detail why this Child Health Care plan is in the best interest of the children. The following are some examples:

Petitioner's adjusted gross income is higher than Respondent's adjusted gross income.

• Petitioner has more disposable earnings than Respondent.
• Petitioner has insurance available through employment at a reasonable rate.
• The children are currently covered by Petitioner's health care policy.
• Petitioner has enrolled the children in Medicaid.

Respondent's adjusted gross income is higher than Petitioner's adjusted gross income.

• Respondent has more disposable earnings than Petitioner.
• Respondent has insurance available through employment at a reasonable rate.
• The children are currently covered by Respondent's health care policy.
• Respondent has enrolled the children in Medicaid.
